RESOLUTION NO. 1-06. DECLARATION OF PERMANENT STATUS OF TOWN OF
FOREST HEIGHTS CHARTER AMENDMENT RESOLUTIONS 3-14

ENACTED:


WHEREAS, the Section 33-90 of the Charter of the Town of Forest Heights and Article 23A § 12 and 13 empower and regulate the Town Council in enacting charter amendments and the Mayor in posting and publication of proposed charter amendments; and


WHEREAS, on November 7, 2005 and again on November 16, 2005 the Town Council of Forest Heights passed Charter Amendment Resolutions 3-14, whose posting and publication requirements were met via court order from the Circuit Court for Prince Georges County, Maryland; and


WHEREAS, the legislative body of the Town of Forest Heights, the Town Council, has not received a verifiable petition for referendum from the citizenry of Forest Heights or any representative thereof pursuant to Article 23A of the Annotated Code of Maryland;


NOW THEREFORE BE IT RESOLVED and hereby DECLARED that Charter Amendments 314, shall become permanent and in effect at 00:00:01 a.m. on Friday, January 6, 2006 and an updated version of the Forest Heights Town Charter including these amendments shall be forwarded to the proper agencies for recordation by the State of Maryland; and


BE IT FURTHER RESOLVED that the current mayor, Joyce A. Beck, is hereby advised and ordered to surrender all property belonging to the Town of Forest Heights and to remove her person, personal effects, and gear from the Forest Heights Town Hall administrative/official areas not later than 11:59:59 p.m. on January 5, 2006; and


BE IT FURTHER RESOLVED that non-compliance with this resolution shall be deemed a misdemeanor and may be subject to forfeiture of property, arrest, 30 days in prison and a fine not to exceed $1,000.00; and


BE IT FURTHER RESOLVED that any incident of non-compliance with this resolution, as determined by a majority vote of the town council, shall be prosecuted and/or referred to the State's Attorney for prosecution by the Town Attorney ; and


AND BE IT FURTHER RESOLVED that this resolution shall take effect immediately upon its passage and the Charter Amendments 3-14 referenced herein shall take effect January 6, 2006.
