TYPOGRAPHICAL CHANGES TO CHARTER AMENDMENTS

PASSED ON SEPTEMBER 19, 2007

WHEREAS, the Section 33-90 of the Charter of the Town of Forest Heights and Article 23A 12 and 13 empower and regulate the Town Council in enacting charter amendments and the Mayor in posting and publication of proposed charter amendments;


WHEREAS, amendments to the Town Charter passed on September 19, 2007 had incorrect dates as to the date of enactment and the effective date of the amendments that were not in conformance with Article 23A, and these are deemed to be of a typographical nature;


NOW, THEREFORE, BE IT RESOLVED that the Town Clerk is hereby authorized and directed to make the following pen and ink changes to the original documents of the charter amendments:

 

(1)       In the Title of each amendment change the Charter amendment numbers as follows:

 

            (a)       The proposed amendment to Charter Section 33-6 shall read: Charter Amendment Resolution Number “29.”

            (b)       The proposed amendment to Charter Section 33-11 shall read: Charter Amendment Resolution Number “30.”

            (d)       The proposed amendment to Charter Section 33-93 shall read: Charter Amendment Resolution Number “31.”

            (e)       The proposed amendment to Charter Section 33-19 shall read: Charter Amendment Resolution Number “32.”

 

(3)       The footers on each page of the original documents shall be revised to reflect the resolution numbers specified in section (1) (a), (b), (c), and (d) above.

 

(4)       On the line entitled “ENACTED” place the date September 19, 2007.

 

(5)       On the second line entitled “AND BE IT FURTHER RESOLVED” place the date November 8, 2007.


AND BE IT FURTHER RESOLVED that the Town Clerk shall post copies of the corrected charter amendment documents in the Municipal Building as soon as possible, but no later than noon Thursday, October 18, 2007. The Town Clerk shall also distribute fliers containing summaries of the proposed charter amendments to all homes in the Town in compliance with the requirements of Article 23A Section 13 (f). The first flier, containing an explanation that the first two fliers already distributed contained inaccurate information about the dates the charter amendment resolutions were enacted and when they would become effective. The fliers shall bring to the citizens attention that the deadline for filing a petition for a referendum on the resolutions is Monday, October 29, 2007.


The first flier is to be distributed to all homes no later than 6:00 p.m. on Thursday, October 18, 2007, and the second flier shall be distributed to all Forest Heights homes no later than 6:00 p.m. on Friday, October 19, 2007.


AND BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon passage.
